These Terms and Conditions constitute a valid, legally binding agreement between you, a verified student user ("User", "You", or "Your"), and Pookpit Hub Private Limited. By downloading, accessing, browsing, or creating an account on the PookPit mobile application or web domain, you explicitly agree to comply with and be bound by these terms.

2.1 Mandatory Student Authentication

Platform access is strictly restricted to active students currently enrolled at a recognized educational institution or university. To enforce a secure campus ecosystem, you must register and log in using your official university-issued email address domain (e.g., user@college.edu.in).

2.2 Informed Consent for Validation

By registering, you grant your explicit, unconditioned, and voluntary consent to PookPit to utilize your institutional email domain to verify your active student status.

• You choose to utilize this application entirely of your own free will.
• If your college domain email is suspended, revoked, or deactivated upon your graduation or due to disciplinary actions by your institution, PookPit shall instantly terminate or suspend your platform access without prior notice.

PookPit operates as a safe, legal campus network. Under the Information Technology Rules, 2021, and the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, there is an absolute zero-tolerance policy for illicit listings.

Absolute Platform Ban: You are strictly prohibited from listing, advertising, requesting, selling, lending, sharing, or discussing any of the following items on any module of the PookPit application:

• Narcotics, psychotropic substances, illegal drugs, or synthetic formulations.
• Prescription-only medicines or pharmaceutical chemicals.
• Alcohol, liquor, tobacco, cigarettes, e-cigarettes, or vaping paraphernalia.
• Weapons, ammunition, explosives, hazardous chemicals, or fireworks.
• Any item or substance whose possession, sale, or trade is restricted or illegal under the laws of India.

Any violation of this clause will trigger immediate permanent account deletion, a permanent ban from the platform, forfeiture of internal ledger balances, and mandatory reporting to your university administration and local police authorities.

PookPit operates as an online marketplace and communication intermediary under Section 79 of the Information Technology Act, 2000. Unless explicitly stated otherwise, the Company acts solely as a technological facilitator and assumes no title, ownership, or liability for transactions conducted between users.

4.1 “Borrow & Share” Module (Articles, Gadgets, & Personal Belongings)

• Intermediary Status: PookPit does not possess, inspect, maintain, or verify any physical belongings listed for P2P lending.
• Risk and Damage Allocation: The contract for borrowing is strictly bipartite between the Lender and the Borrower. The Borrower assumes total financial and physical liability for the borrowed asset (including smartphones, laptops, cameras, books, or tools) from the exact moment of physical handover.
• Condition of Items: All items are listed and transferred on an “As-Is, Where-Is” basis. If an item is broken, unreturned, lost, or stolen, the Borrower is legally obligated to compensate the Lender for the market value of the item. PookPit disclaims all liability for property damage or financial losses arising from this module.

4.2 Marketplace Module (Buy & Sell of Gadgets, Belongings, & Eateries)

• Private Bipartite Sales: The sale of items via the marketplace is exclusively a transaction between the student seller and the student buyer.
• Eateries & Prepared Foods Disclaimer: For any homemade food, snacks, or eateries listed by students, the student seller warrants that the food is freshly prepared, completely safe, sanitary, and free from contaminants or hazardous substances. PookPit does not inspect cooking spaces and assumes zero liability under the Food Safety and Standards Act (FSSAI), 2006, for foodborne illnesses, bacterial infections, or allergic reactions caused by marketplace eateries.

4.3 “Peer Help” Module & Conditional Anonymity Architecture

• Masked Initial Communication: To protect user privacy, students may create help groups and communicate within specialized campus threads where their true identities remain hidden and masked from all other platform users.
• The “Deal” Trigger: You acknowledge and agree that your anonymity within this module is strictly conditional. The exact moment a transaction, deal, meeting, or assignment is mutually confirmed and accepted by both parties via the in-app interface, anonymity is stripped automatically.
• Automated Mutual Disclosure: Upon the finalization of a deal, the PookPit system will instantly disclose the following identification data to both parties to ensure personal safety and accountability during the physical encounter: (1) verified mobile numbers; (2) pinpointed cross-verification location data for the deal exchange; (3) real legal names and the designated community titles of both peers.
• Backend Logs: Absolute anonymity does not exist on the company servers. PookPit maintains unmasked identity records on its secure backend databases at all times to satisfy legal data-tracing requirements under the Bharatiya Nyaya Sanhita (BNS), 2023.

4.4 Mental Health & Well-Being Support Module

• Non-Clinical & Non-Emergency Disclaimer: This feature is strictly a peer-to-peer interactive forum for self-reflection, sharing, and empathetic peer discussion. PookPit is not a registered medical institution, clinical health clinic, or psychiatric crisis center. The platform does not dispense clinical therapy, medical advice, or psychiatric diagnostics.
• Confidentiality Scope: PookPit guarantees that all personal insights, journals, and peer conversations logged inside this module remain strictly confidential and shielded from your college authorities, external users, and employers.
• Consent for Third-Party Specialist Escalation: By opting to receive professional structural solutions, you provide your explicit, informed consent to PookPit to securely transmit your logged data, insights, and platform inputs to integrated, verified third-party mental health specialists, clinical counselors, or accredited psychologists who are independently contracted to execute wellness interventions.
• Imminent Threat Clause: If internal logging indicates a high probability of immediate self-harm, medical emergency, or physical violence, PookPit reserves the legal right to breach confidentiality to notify institutional counselors, family emergency contacts, or emergency medical response services.

5.1 Internal Wallet System

The PookPit Wallet is a closed, proprietary, internal platform ledger managed strictly and exclusively by the Company. It does not utilize external escrow token frameworks for commission tracking.

5.2 Explicit Fund Retention Consent

By depositing money into your PookPit Wallet or accepting peer payments, you grant your unconditioned, irrevocable consent to the Company to:

• Act as an internal custodian of your funds to settle transactions within the app ecosystem.
• Hold transaction values internally until peer exchanges are marked as validated and closed by both users.
• Automatically deduct platform processing fees, operational commissions, or verified peer dispute penalties from your wallet balance prior to processing any bank payouts.
• Temporarily freeze internal ledger account balances if a transaction is flagged for potential fraud, unauthorized chargebacks, or a breach of these Terms.

Any educational institution, university, or college student body that signs a Memorandum of Understanding (MoU) or collaborates to roll out PookPit on their campus agrees to abide by these platform rules.

• No Vicarious Corporate Liability: Partner institutions act as promotional or ecosystem facilitators only. They do not assume any legal or financial liability for peer-to-peer theft, physical accidents, contractual disputes, or platform malfunctions occurring between individual students on the platform.

7.1 Indemnity

You agree to indemnify, defend, and hold harmless Pookpit Hub Private Limited, its directors, shareholders, and employees from and against any third-party claims, legal losses, damages, liabilities, and expenses (including court fees and legal representations) arising directly or indirectly from your violation of these Terms, listing of banned substances, or damage inflicted on another peer's property.

7.2 Limitation of Liability

To the maximum extent permitted by applicable Indian law, Pookpit Hub Private Limited shall not be liable for any indirect, consequential, punitive, exemplary, or incidental damages. This includes, but is not limited to, physical injuries, food poisoning from campus eateries, loss of data, psychological distress, or financial default between peers.

7.3 Governing Law & Legal Forum

These Terms and Conditions shall be governed, interpreted, and enforced strictly in accordance with the laws of the Republic of India. Any legal dispute, action, or litigation arising out of or concerning your use of the PookPit application shall be subject to the exclusive jurisdiction of the competent courts in Moradabad, Uttar Pradesh, India.
